Songably is a digital service operated by P-Digital V.O.F., a registered company in the Netherlands. We create personalised AI-generated songs delivered as digital audio files (MP3) to your email address.

2. The Service

2.1 What we provide

Songably creates personalised songs using artificial intelligence based on the information you provide at checkout. Each order includes:

• One personalised song in MP3 format
• The full lyrics of the song
• Delivery to your email address within 24 hours of payment

If you add the optional second song at checkout, the same deliverables apply for that song as well.

2.2 AI-generated content

All songs created by Songably are generated using artificial intelligence. By placing an order, you acknowledge and accept that:

• The song is created by AI and not by a human songwriter
• The output may vary in style, tone, and quality
• We make reasonable efforts to create a high-quality, personalised result based on your input
• The more detail you provide, the more personalised the result will be

2.3 Delivery

Songs are delivered to the email address provided at checkout within 24 hours. In most cases delivery is significantly faster. Delivery times may be longer during peak periods such as Mother's Day, Christmas, and Valentine's Day. We will notify you by email if a delay is expected.

It is your responsibility to provide a correct and accessible email address. Songably is not responsible for non-delivery due to an incorrect email address, full inbox, or spam filters.

3. Ordering and Payment

3.1 How to order

To place an order, complete the order form on our website with the required details and proceed to checkout. Your order is confirmed once payment has been successfully processed.

3.2 Pricing

All prices are displayed on the website at the time of ordering. Prices are shown in US dollars (USD) unless otherwise indicated. Promotional prices and discounts are valid only for the period stated and may be withdrawn at any time without notice.

3.3 Payment processing

All payments are processed securely by Stripe, Inc. By providing your payment details, you authorise Stripe to charge the stated amount to your payment method. We do not store or have access to your card details.

Your order is only confirmed once payment has been fully processed. If payment fails, no order will be placed and no song will be created.

4. Revisions and Satisfaction

We want you to be happy with your song. If the delivered song does not match the details you provided, or if you feel it falls short of a reasonable standard, please contact us at hello@songably.com within 7 days of delivery.

We offer one free revision per order. A revision means we will regenerate the song based on updated or clarified instructions. A revision is not a full refund — it is an opportunity to improve the result.

We reserve the right to determine whether a revision request is reasonable. Requests based solely on personal taste or preference (e.g. preferring a different musical style after having chosen one) may not qualify for a free revision.

5. Refund Policy

5.1 Digital products

Because Songably delivers digital products that are created specifically for you, all sales are generally final once the song has been delivered. This is consistent with consumer protection regulations applicable to custom digital goods.

5.2 Non-delivery

If you do not receive your song within 48 hours of placing your order, please contact us at hello@songably.com. If we are unable to deliver your song, you are entitled to a full refund.

5.3 Refund requests

Refund requests are handled on a case-by-case basis. We will consider a refund in the following situations:

• The song was never delivered despite a correct email address
• The delivered song contains a significant error that we are unable to correct through revision
• A technical error occurred during checkout resulting in a duplicate charge

To request a refund, email hello@songably.com within 7 days of your order date. Include your order details and a description of the issue. We aim to respond within 3 business days.

6. Intellectual Property

6.1 Ownership of delivered songs

Upon full payment and delivery of your song, Songably grants you a non-exclusive, worldwide, royalty-free licence to use the delivered MP3 and lyrics for personal, non-commercial purposes. This includes:

• Playing the song privately or at personal events such as birthday parties
• Sharing the song with friends and family via messaging apps or social media
• Keeping a permanent copy for personal use

6.2 Restrictions

You may not, without our prior written consent:

• Sell, license, or commercially exploit the song or lyrics
• Use the song in commercial advertising, film, television, or other commercial media
• Claim authorship or copyright of the song or lyrics
• Register any copyright in the song or any derivative work

P-Digital V.O.F. retains all intellectual property rights in the underlying technology, prompts, and processes used to create the songs.

6.3 Content you provide

By submitting personal details about the recipient at checkout, you confirm that you have the right to share this information and that doing so does not infringe the privacy or rights of any third party. You grant Songably a limited licence to use this information solely for the purpose of creating your song.

7. Acceptable Use

You agree not to use Songably to create songs that:

• Are defamatory, harassing, threatening, or abusive toward any individual
• Contain hate speech or discriminate on the basis of race, gender, religion, nationality, sexual orientation, or disability
• Infringe the intellectual property rights of any third party
• Are intended to deceive or defraud any person
• Violate any applicable law or regulation

Songably reserves the right to refuse any order at our discretion. If we determine that submitted content violates these terms, we will cancel the order and issue a full refund.

8. Limitation of Liability

To the maximum extent permitted by applicable law, P-Digital V.O.F. shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from your use of our service
• Loss of data, revenue, goodwill, or anticipated savings
• Any damage arising from your inability to access the service due to technical issues beyond our control

Our total liability to you for any claim arising out of or in connection with these terms shall not exceed the amount you paid for the relevant order.

Nothing in these terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

9. Disclaimers

Songably is provided on an "as is" and "as available" basis. We do not guarantee that:

• The service will be uninterrupted, error-free, or available at all times
• The AI-generated song will meet your specific expectations or preferences
• The song will be suitable for any particular purpose

We make no warranty, express or implied, regarding the quality, accuracy, or fitness for purpose of any song created through our service.

10. Third-Party Services

Our service relies on third-party platforms including Stripe (payments), Klaviyo (email marketing), Resend (transactional email), Google Analytics (website analytics), Microsoft Clarity (behavioural analytics), and Meta (advertising). We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of these services is governed by their respective terms and policies.

We use Google Analytics 4 with Consent Mode v2 to analyse website usage. Google Analytics only sets cookies and collects identifiable data after you have accepted cookies via the cookie banner on our website.

We use Microsoft Clarity to record anonymised session replays and heatmaps that help us understand how visitors interact with our website. Clarity may collect behavioural data such as mouse movements, clicks, and scroll depth. For more details, see our Privacy Policy.

11. Privacy

Your use of Songably is also governed by our Privacy Policy. The Privacy Policy is incorporated into these Terms of Service by reference. By using our service, you confirm that you have read and understood our Privacy Policy.

12. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be effective immediately upon posting to our website. The date at the top of this page will reflect the most recent update. Your continued use of Songably after any changes constitutes your acceptance of the updated terms.

For significant changes, we will make reasonable efforts to notify active customers by email.

13. Governing Law and Disputes

These Terms of Service are governed by the laws of the Netherlands. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands, unless mandatory consumer protection laws in your country of residence provide otherwise.

We always prefer to resolve disputes amicably. If you have a complaint or concern, please contact us at hello@songably.com before initiating any legal proceedings. We aim to resolve all complaints within 14 days.
